Revisions to Mendip Local Plan Part II following Statutory Review

- This Plan includes revisions to text, inset maps and policies following a Statutory Review in the High Court challenging parts of the adopted Mendip District Council Local Plan Part II Sites and Policies.
- The Judgement of Hon. Mr Justice Holgate was handed down on 16th December 2022. It is accompanied by an Order directing the Council to make revisions to this Plan. Copies of both these documents can be found online.
- Two grounds of challenge to the adopted Plan were upheld by the Court relating the housing sites allocated in the north-east of the district. These sites have been remitted back to Mendip District Council. The relevant policies and supporting text are deleted from the adopted Local Plan Part II and are shown as ‘struck-out’ of this document. No weight or regard can be given to these policies or their supporting in the determination of planning applications.
- The policies which are subject to the Order and struck out are:
Policy MN1 Land at White Post, Midsomer Norton
Policy MN2 Land at Underhill Lane, Midsomer Norton
Policy MN3 Land east of the A367, Midsomer Norton
Policy BK1 Land off Great Dunns Close. Beckington
Policy NSP1 Land off Mackley Lane, Norton St Phillip
Consequential changes from the deletion of these policies have also been made to Section 3 of this Plan (Housing Land) including adjustments to summary tables of allocations and dwellings to be delivered over the plan period.
- Development and allocation policies in the remainder of Local Plan Part II remain as adopted on 20th December 2021.
