Explanatory Note

Revisions to Mendip Local Plan Part II following Statutory Review
16th December 2022 and Limited Update adopted September 2025.

  1. This Plan includes revisions to text, inset maps and policies following a Statutory Review in the High Court challenging parts of the adopted Mendip District Council Local Plan Part II Sites and Policies.
  2. The Judgement of Hon. Mr Justice Holgate was handed down on 16th December 2022. It is accompanied by an Order directing the Council to make revisions to this Plan. Copies of both these documents can be found online.
  3. Two grounds of challenge to the adopted Plan were upheld by the Court relating the housing sites allocated in the north-east of the district. These sites have been remitted back to Mendip District Council. The relevant policies and supporting text are deleted from the adopted Local Plan Part II and are shown as 'struck-out' of this document. No weight or regard can be given to these policies or their supporting in the determination of planning applications.
  4. The policies which are subject to the Order and struck out are:

    Policy MN1 Land at White Post, Midsomer Norton
    Policy MN2 Land at Underhill Lane, Midsomer Norton
    Policy MN3 Land east of the A367, Midsomer Norton
    Policy BK1 Land off Great Dunns Close. Beckington
    Policy NSP1 Land off Mackley Lane, Norton St Phillip

    Consequential changes from the deletion of these policies have also been made to Section 3 of this Plan (Housing Land) including adjustments to summary tables of allocations and dwellings to be delivered over the plan period.
  5. Development and allocation policies in the remainder of Local Plan Part II remain as adopted on 20th December 2021.
  6. Somerset Council adopted a Limited Update to this Plan on 25th September 2025 which identifies nine housing allocations which replace those deleted and addresses the directions of the High Court Order. The limited update is a separate document which is available online or reproduced at the end of this written statement.

  1. The replacement housing allocations adopted by Somerset Council are

    Policy GL6 Land off Common Moor Drove, Glastonbury
    Policy GL7 Land at Norbins Road, Glastonbury
    Policy ST5 Land to rear of Crispin Centre, Street
    Policy ST6 Land at Brooks Farm, Street
    Policy WL6 Wells Police Station Policy MN1 Land at White Post Midsomer Norton
    Policy MN4 Land at Beauchamps Drive
    Policy CL2 Anchor Road, Coleford

  2. These sites are additional to those shown in Tables 1 and 2 in this Plan. For clarity, no consequential changes have been made to this version of the Local Plan Part II.

Erratum

  1. The following corrections to the adopted Local Plan Part II should be noted and were publicised as Additional Modifications to the Limited Update.

    Page 30 - Policy DP25 Employment Land
    Line 4 – 'Table 7' should read 'Table 5'

    Page 84 Policy WL1 Land off Bubwith Walk
    under 'context' - third sentence
    '... and southerly field (opposite Stilling Close)’ should read
    '... and middle field (opposite Martin Close)
